What are Board Policies?
Section 9(a) of the Queensland Building Services Authority Act 1991 (the Act) provides that one of the functions of the Queensland Building Services Board (the Board) is to make and review policies governing the administration of the Act.
The Act specifically provides for the Board to make policies about financial requirements for licensing and the terms for a policy of insurance under the home warranty statutory insurance scheme. In addition, guideline policies can be made by the Board on other matters governing the administration of the Act.

Rectification of Building Work Policy
The functions and responsibilities of the General Manager of BSA include the issuing of directions to rectify defective or incomplete building work (s18 and s 72 of the Act). BSA takes into consideration the Rectification of Building Work policy, as well as all other circumstances it considers are reasonably relevant, in deciding whether to give a direction to rectify building work under section 72 of the Act.
The guideline policy commenced on 12 March 2010. As of the date of commencement, the policy rescinds and replaces the two previous Board guideline policies relating to rectification of building work and rectification of susidence and settlement. On 1 July 2010 Schedule 1 of the policy was amended to insert a revised paragraph (b)(v) to more effectively address the engineering determinations in respect of the use of piers. These policies and their ongoing relevance to building work and contracts for building work entered into prior to the commencement of the new Rectification of Building Work policy are discussed further below.
Power to Require Rectification of Building Work Policy (Repealed)
This policy was rescinded on 12 March 2010. However, for building work commenced between 1 September 2004 and 12 March 2010, the policy will continue to be taken into consideration by the BSA (as part of all the circumstances it considers reasonably relevant) in deciding whether to give a direction to rectify under section 72 of the Act.

Subsidence/settlement - Responsibility for Rectification Policy (Repealed)
This policy was rescinded on 1 September 04 by the Rectification of Building Work policy. However, the policy will continue to be taken into consideration by the BSA (as part of all the circumstances it considers reasonably relevant) in deciding whether to give a direction to rectify if:
The contract for the building work was entered into prior to 1 September 2004; or
The written preliminary agreement to contract for the building work was entered into prior to 1 September 2004.
