What is a variation?
Variations involve a change to the original contracted works. This may involve either an addition to, or reduction in, the scope of work which may result in an increase or decrease in the cost (value) of the work. Failure to fully and accurately document changes to the original contract is a frequent cause of disputes.

Put it in writing
All variations agreed to between you and the contractor must be put in writing and signed by yourself and the contractor.  The contractor should provide you with a copy of the variation document as soon as practicable after signing. The only exception is if the work is required urgently and it is not practical to produce a variation document before work commences. The contractor must give you a copy of the variation document within five business days of when the variation was agreed to.

What if the variation involves extra work?
If a variation requested by a contractor involves additional work you are only liable to pay for the extra work if the contractor could not reasonably foreseen the additional work at the time of entering the contract. The contactor must not demand payment for variations before the work has commenced.
