BSA is able to provide assistance in relation to defective building work where you and the contractor are unable to reach an amicable solution.
What is defective building work?
There are two categories of defective building work, Category 1 and Category 2, for which a contractor may be held responsible and required to rectify. It is important to note that specific time frames apply in relation to BSA's ability to investigate, and possibly request a contractor to rectify defective building work.
Note - there are instances when BSA is not able to assist. A specific list of exemptions can be found in the Queensland Building Services Authority Regulation 2003 - s5. Generally BSA can not assist with complaints where:
The work carried out is $3,300 or under in value. Note - plumbing, drainage, gas fitting, termite management chemical, building design and completed building inspection reports are exempt from this threshold and BSA may investigate a complaint for any value of work carried out in these categories.
There is a dispute regarding the fulfilment of the contract conditions and/or contract payments.
The Queensland Civil and Administrative Tribunal provides a cost effective dispute resolution service (and mediation) for disputes of a contractual nature.
What can BSA do?
