In downloading and using the pdf versions of BSA contracts I agree not to alter the terms and conditions of the contracts other than by way of special conditions.

If extra copies of the forms or schedules included in the contracts are required (e.g. to document progress claims and variations), they may be downloaded or photocopied for multiple use. These forms and schedules should not be modified without legal advice and the agreement of both the building owner and the building contractor.

In the case of the New Home Construction Contract, the Renovation, Extension and Repair Contract, and the Natural Disaster Repairs Contract, I acknowledge that I am aware that the Domestic Building Contracts Act 2000 requires the building contractor to give the building owner a readily legible signed copy of the entire contract (including any schedules, plans and specifications, etc.) and a copy of the approved contract information statement for the contract as soon as practicable (but within 5 business days) after the contract is entered into.

NOTE: Failure by a building contractor to properly document the agreement (including variations) and provide the necessary copies to the building owner increases the risk of disputes and may result in prosecution of the contractor, contract termination or the contractor’s inability to enforce payment.
