What is Tier 1 Defective Work?
Work that falls below the standard reasonably expected of a licensed contractor for the type of building work; and either:

  • Adversely affects the structural performance of a building to the extent that a person could not reasonably be expected to use the building for the purpose for which it was, or is being, erected or constructed (ie requires substantial reconstruction or demolition); or
  • Likely to cause the death of or grievous bodily harm to, a person (ie fire protection not up to safety standard).

    BSA's Contractual Obligations, Demerit Points and Bans booklet provides more information about tier 1 defective work and the processes leading up to a ban. A banned individual is considered not fit and proper to hold a licence.
    Length of Bans
    First offence - three year ban
    Second offence - within 10 years of the first ban - banned for life
