What is BSA's role in relation to design complaints?
BSA provides an auditing role in assessing complaints in relation to sub standard design such as non compliance with building codes and standards. BSA can only provide an audit role in the assessment of sub-standard design plans and does not have any legislative powers to direct the designer to pay any compensation for unsatisfactory design work. Where the issue is of a contractual nature (e.g. costs) BSA can not assist.
Who can make a complaint?
Any complaint made against a building designer must originate from the person/s that requested the design plans be created (i.e. owner or builder).
When should the complaint be made?
The complaint must be lodged as soon as practical after the design fault is discovered (this may be before or during construction of the building work).
How can a complaint be made?
1. You must complete and return (via mail or in person) a Residential and Commercial Construction Work Complaint Form.
2. You must also provide a copy of the design plan in question and a copy of a current rates notice or title deed for the property in question.
What can BSA do?
BSA may inspect the premises and issue you with an investigative report and can direct the designer to supply a compliant set of plans. You will be able to use the report (in conjunction with legal advice) in the Queensland Civil and Administrative Tribunal to try to obtain compensation.
