Direction to Rectify
BSA is able to direct rectification of defective or incomplete building work by a person and/or company responsible for carrying out that building work.

You are given opportunity to rectify any defective work prior to the issue of a direction. Process before direction:

  • Phone mediation
  • On site meeting  

    In most cases BSA will issue a direction to rectify immediately following the site meeting on all outstanding defective work.

    Where a Direction to Rectify is issued you will automatically incur an additional fee on your annual renewal fee. Further information is available on the Renewing page.

    Failure to comply with a Direction to Rectify
    Any failure by you to comply with a BSA Direction to Rectify within the time specified may lead BSA to commence actions that can include:

  • The imposition of two (2) demerit points upon your licence
  • A maximum penalty if prosecuted in the tribunal / courts up to $25,000 or a $2,000 penalty if BSA issues an infringement notice upon you (as at 1 January 2009).
  • Disciplinary action in the Queensland Civil and Administrative Tribunal or the Courts
  • Imposition of conditions on your licence
  • Issuing of show cause notices that may result in the cancellation or suspension of your licence

    Can a decision be reviewed?
    Correspondence you receive from BSA should identify whether the decision can be reviewed (a list of reviewable decisions is contained in the Queensland Building Services Authority Act 1991). A review of a decision or assessment of a complaint is conducted in the Queensland Civil and Administrative Tribunal.
