What is a nominee supervisor?
A company MUST have a nominee supervisor who holds a BSA licence in the same class the company has applied for and who is responsible for ensuring that the building work carried out by the company is adequately supervised. This means that you and the directors of the company must put in place a system of supervision that ensures the company's building work complies with the plans & specifications and is of a competent standard expected of a licensee. The nominee supervisor MUST be an employee, secretary or director of the company.

What work can a nominee supervisor supervise?
A nominee supervisor can only supervise work of the class of licence they hold e.g. a carpenter can only supervise carpentry work. They can not contract or subcontract to carry out building work.

Who can be a nominee supervisor for a company?
Holder of a contractor licence - is able to supervise work on behalf of the company (must be an employee or officer of the company). The holder of a contractor licence can also contract to builders and owners to perform building work in the class of licence they hold.
e.g.
Licensee B is an employee of, and the nominee supervisor for company X. Licensee B supervises work being carried out under contracts for company X. B is also able to undertake building work outside of this employment and contract with home owners and builders.

Holder of a nominee supervisor licence - is able to supervise work on behalf of a company (must be an employee or officer of the company). A nominee supervisor CAN NOT contract to builders and owners to perform building work. All contracts must be in the company name.
e.g.
Licensee C is an employee of, and the nominee supervisor for company X. C supervises work being carried out under contracts for company X. Licensee C can not undertake building work outside of this employment (unless the work does not require a licence).

What is involved in getting a licence?
Refer to application information for builders or trade contractors and designers.

Note: Where you choose nominee supervisor grade (at Q2 on the application form) NO FINANCIAL INFORMATION IS REQUIRED. This includes any requirements for mandatory Professional Indemnity (PI) Insurance.

You should seek independent legal advice to establish what your responsibilities and obligations would be as the nominee supervisor for a company.
