Fit and Proper
A person is entitled to a contractor’s licence if they are ‘fit and proper’ to hold the licence. BSA is committed to ensuring that applicants are, and licensees continue to be, fit and proper persons to hold a contractor’s licence.
What are the criteria for assessment of a fit and proper person to hold a contractor's licence?
Any commercial and other dealings that involved the applicant and in particular the standard of honesty and integrity demonstrated in those dealings
Failure by that person to carry out commercial or statutory obligations and the reasons for the failure
Whether the person has carried out any Tier 1 Defective Work
Whether the person has failed to pay an infringement notice for an offence under the Queensland Building Services Authority Act 1991 or the Domestic Building Contracts Act 2000
Any other relevant factor
BSA may consider a person is not fit and proper where it is believed the applicant (or licensee) could not be presented as someone who can be trusted with work covered by the licence.
What happens if you are not classified as a fit and proper person - what happens?
Your licence application will not be granted
Your existing licence will be suspended or cancelled
You have the right to appeal BSA’s decision through the Queensland Civil and Administrative Tribunal.
